Agreement

These Terms of Service ("Terms") govern your use of NoiseTape, a white-noise and sleep-sounds app for iPhone, iPad, and Mac, and the NoiseTape website. NoiseTape is provided by NEXALIFY LIMITED ("we", "us", or "our").

By downloading, accessing, or using NoiseTape, you agree to these Terms. If you do not agree, do not use NoiseTape.

NoiseTape Service

NoiseTape is an offline ambient-sound player. The app includes bundled sound files, playback controls, favorite sounds, language settings, background audio support, and a sleep timer.

NoiseTape is free to download and includes a 14-day free trial. After the trial, a single one-time in-app purchase unlocks the full app permanently; there is no subscription. NoiseTape uses local settings and bundled audio, and does not include online profiles, chat, cloud sync, or interactive community features.

Purchases

NoiseTape is distributed through the Apple App Store, and the one-time unlock is offered as an in-app purchase. Purchases, refunds, billing, taxes, family sharing, and download rights are handled by Apple under Apple's applicable terms. We do not process your payment card information.

Any displayed price may vary by region and currency. App Store availability and pricing are controlled through App Store Connect and may change from time to time.

License

Your use of the app downloaded from the Apple App Store is also governed by the Apple Standard End User License Agreement, unless Apple or we provide a different license that applies. These Terms do not replace Apple's App Store terms.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use NoiseTape for personal, non-commercial purposes on devices you own or control.

Acceptable Use

You agree not to copy, modify, reverse engineer, decompile, resell, redistribute, rent, lease, sublicense, or misuse NoiseTape except where allowed by law. You also agree not to interfere with the app or website, attempt unauthorized access, or use NoiseTape in a way that violates applicable law.

Intellectual Property and Third-Party Content

NoiseTape, including its app interface, website, text, graphics, branding, and software, is owned by us or our licensors and is protected by intellectual property laws.

Some ambient sound content is derived from XMSLEEP by Tosencen and used under the MIT License. We retain or provide attribution where appropriate. You may not extract, redistribute, or sell NoiseTape's bundled sound library separately from the app.

No Medical Advice

NoiseTape is intended for relaxation, focus, and sleep support. It is not a medical device, healthcare service, therapy, diagnosis tool, or treatment. If you have a medical condition, sleep disorder, hearing concern, or mental health concern, consult a qualified professional.

Support and Updates

We may provide updates, fixes, improvements, or changes to NoiseTape. We are not required to provide any particular feature or maintain compatibility forever. Support is available by email at [email protected].

Privacy

Your use of NoiseTape is also governed by our Privacy Policy, which explains that the app works offline, does not require an account, and does not collect personal information from the app.

Disclaimer

NoiseTape is provided "as is" and "as available" to the maximum extent permitted by law. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, NEXALIFY LIMITED and its directors, employees, contractors, and partners will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from your use of NoiseTape.

Where liability cannot be excluded, our total liability will be limited to the greater of the amount you paid for NoiseTape in the twelve months before the claim or the minimum amount required by applicable law.

Termination

You may stop using NoiseTape at any time. We may suspend or terminate access to the website or any service component if you violate these Terms or if required by law. Because the app does not use accounts, deleting the app from your device is the main way to stop using it.

Governing Law

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules, except where consumer protection laws in your location require otherwise.

Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the "Last Updated" date above. Continued use of NoiseTape after an update means the revised Terms apply.
